The South Central Workforce Investment Board (SCWIB) requests bids for a One Stop Operator of the Workforce Innovation and Opportunity Act (WIOA), and other state and federally funded programs of the South Central Region for the fiscal year ending June 30, 2026. Subject: Clarification on Leave Responsibility for One-Stop Operator Staff Hired Through Competitive Award
I am seeking clarification regarding the staffing structure when the One-Stop Operator is selected through a competitive procurement process.
If the awarded organization fills the One-Stop Operator position with one of their current employees, will that employee retain their existing annual and sick leave balances under their current employer? Or, if applicable, would the Fiscal Agent (SCWIB) assume responsibility for managing or honoring those leave balances?
Your guidance on how this transition is handled — particularly in relation to benefits continuity — would be greatly appreciated.
Answer: If the SCWIB awards the One-Stop Operator contract to an agency/company/organization, the employer of record would be the contractor, not the SCWIB. Accrued/existing/used leave would be the responsibility of the employer of record. The SCWIB would not assume any responsibility for managing or honoring leave balances.
